Preliminary Note:

The term Operator means My Soccerclub Srl, based in Zona Industriale Colleranesco, Taxpayer Number and VAT Number 01684620675

The term A.S. Squadramia means Sporting Association Squadramia, established with notary's act of Andrea Costantini of 11th september 2008 and registered on 12th september 2008 having Taxpayer Number 91035960672

Conditions of Payment

Section A – Payments received prior to the purchase of the football club

Payment of the annual fee in the ammount specified in the rules of the A.S. Squadramia prior to the purchase of the football club:

1. If not otherwise provided, the payer becomes a Member of the A.S. Squadramia from the date of payment to a date which is 12 months from the purchase of the football team.

2. In case it wasn't possible to purchase any football team before 31th July 2010, the Operator has to refund the fees as soon as reasonably practicable in accordance to the contract between the two parties.

Section B – Payments received after the purchase of the football club

Payment of the annual fee in the ammount specified in the rules of the A.S. Squadramia after the purchase of the football club:

1. If not otherwise provided, the payer becomes a Member of the Association from the date of payment to 12 months after the same.

Section C – Terms relating to all payments (prior or after the purchase of the football club)

1. Every member represents and warrants to the Association and to the Operator that on the date of payment and in every moment that he/she remains a member that he/she: (a) is of age or, if underage, subscribed with an application countersigned by parents or the person acting in his place; (b) is making or has made the payment from his/her own freely available funds, and that the payment is not being made on behalf of a third party; (c) has read, understood and accepts fully the Certificate of Incorporation ("Atto Costitutivo"), the Articles of Association ("Statuto"), the Rules ("Regolamento") and the Contract ("Contratto") between the Operator and the A.S. Squadramia (Documents for download at the end of this page). The Association and/or the Operator on behalf of the Association may cancel the membership of the payer if these representations and warranties are breached, but shall not be liable to refund the initial payment.

2. The Operator may in every moment and by its unquestionable judgement inhibit the use of all its Internet services to a member who doesn't respect the Netiquette or who's writing messages in any part of the Website which bother other members or which are offensive to other's people dignity or containing racist and/or vulgar indications or expressions. The Operator may furthermore remove those members who are using symbols, images, expressions which make reference to political ideologies or conceptions. Finally the Operator reserves the right to remove any abuse without the need of premonition.

3. Differently the membership may only be cancelled in accordance with the Articles of Association. Any exclusion from the Association (whether by the request of a member, the Association or the Operator in accordance with these Terms and Conditions or the Contract) doesn't entitle the member to a refund of the whole or any part of the payment.

4. Every subscriber acknowledges and agrees that the payments are being used for the purchase and the management of a football club and associated costs, and that, on the basis of article 24 of the Italian Civil Code, no part of those payments can be refunded or repaid to the payer by the Association or by the Operator (except in case a football club isn't purchased, in accordance with the Rules of the Association).

5. The payment of the membership fee has to be made in accordance with the Rules and the Contract.

Section D – General Terms and Conditions

1. By making a payment, every subscriber becomes a member of A.S. Squadramia. The Certificate of Incorporation, the Articles of Association and the Rules establish the behaviour the member has to keep towards the Association, and the Contract governs the relationship between the Association and the Operator.

2. Members are permitted to join the Association only for personal use and not for commercial purposes, or for any other purpose which contradicts the objects of the Association. In particular, the Operator may suspend members temporarily or permanently from using the Website if it seems obvious that there have been requests for votings with the intention to damage the Website, the football club, the Association or the Operator.

3. Members are only permitted to use the Website during the time their membership is valid, and subject always to the Articles of the Association, the Contract, and to these Terms and Conditions.

4. Every member represents and warrants that: (a) it will not create, administer, sponsor, promote or help actively in any way a website similar to the Website to be created, developed and operated in connection with the administration of the football club purchased by the Association; and (b) it will not use any information made public on the Website by the Operator or the football club which was purchased other than on the Website and other than in connection with the administration of the football club.

Section E – Privacy Policy

Every member represents to accept the Privacy Protection Law reported at the bottom of this page.

Section F – Member Protection

1. The Operator can send e-mails to Members relating to the Association, their membership, or any matter in relation with the services which the Operator agrees to provide in accordance to the Contract's norms without restriction.

2. If not otherwise provided, the Operator will not provide or sell Member’s details to third parties, except the necessary to the Association in order to register the members to the member's book.

3. The Operator may contact the members via email with products, services and promotions.

4. The Operator reserves the right to disclose information about member usage and demographics to its partners, but only in anonymous and aggregate form without mentioning in any way the personal identity of the individuals.

5. All information which is provided to the Operator will be provided to the Association and to the My Soccerclub Srl in its capacity as the Operator in accordance to the Articles of Association and Contract's norms.

6. The Operator may continue to send e-mails to the members whose membership has expired or has not been renewed for a period of 12 months after the date of expiry of the fee, but only in order to encourage them to renew their membership.

Section G – Personal Information

1. The Operator will not sell member's personal information to others without the permission of the member. With permission, the Operator will only share this information with carefully chosen, reputable and relevant third parties. The Operator may provide aggregate statistics on members, sales, traffic patterns and related website information to these third parties. These statistics will not include personal informations.

2. The Operator is not responsible for the content or the privacy policies of websites linked on the Website.

3. The Operator has the right to apply or engage external companies for the supply of services for the data processor. Data processors will abide by the Operator's Privacy Policy and will not be allowed to disclose member's personal data to anyone.

Section H – The Website and the Database

1. The Website and the Database are exclusive proprietary of the Operator. These Terms and Conditions regulate the modalities of access, browse and use of the Website from the members. The members must accept and act in accordance with the Articles of Association and the Contract between the Association and the Operator.

Section I – Changes to the Terms and Conditions

1. The Operator reserves the right to change these Terms and Conditions at any time. As a member, it's necessary to review these Terms and Conditions regularly, including, but not limited to, at every renew or payment of a membership fee. The payment of a membership fee constitutes an acknowledgement that the member read and agreed to the most up to date Terms and Conditions.

2. The Operator will send an e-mail to all members notifying them of all changes to these Terms and Conditions prior to making the change. It will be the responsibility of members to ensure that they read the revised Terms and Conditions. Changes to the Terms and Conditions are effective immediately upon posting to the Website.

3. A member’s continued use of the Website after a change to the Terms and Conditions involves to the member the automatic acceptance of all changes to the Terms and Conditions.

Section J - Members, whether individuals or agents of media or other organizations

1. Members must not in any way attempt access without authorization, damage and/or modify any part of the Website, on the Server and/or on the Online Bank Accounts of the Operator.

2. Members must not post, transmit, make references, post a link containing any material which is false, fraudulent, inaccurate or incomplete, obscene, offensive, deformed, illegal, meaningless, in infringement of copyright and in contrast with any statute's norm and/or law.

3. Members must not use vulgar or offensive language on the forum or the chat.
